Distributed Generation. California opened a rulemaking proceeding to consider regulatory reforms in electricity distribution service, with a possible focus on distributed generation. The commission emphasized that its intent was not to define new policies, but to gather information. Comments are due March 17, and the commission intends to consider a proposal from the assigned commissioner this summer. Rulemaking 98-12-015, Dec. 17, 1998 (Calif. P.U.C.).

Gas Transportation Rates.

NATIONAL ASSOCIATION OF Regulatory Utility Commissioners (NARUC) President Jolynn Barry Butler appointed Maureen O. Helmer, chairman of the New York Public Service Commission, to serve on the NARUC Committee on Electricity. As a member of the committee, Helmer will work with other state commissioners to develop policy positions.

Steven M. Nagy joined Detroit Edison as manager, supply chain and procurement. Nagy comes to Detroit Edison from Huntsville Electronics, the electronics division of Chrysler Corp., where he served as the division's manufacturing operations manager.

The board of Ameren Corp. elected Charles D. Naslund assistant vice president, power operations. Naslund will help manage operation of the power plants of Union Electric, now known as AmerenUE.

The Texas Public Utility Commission named Saralee Tiede the new director of the Office of Customer Protection. Tiede will replace Bill Magness, who was chosen a year ago to direct the PUC's customer education and response program.

Chairman James J. Hoecker named David P. Boergers to the post of secretary of the Federal Energy Regulatory Commission.

Power Pools & Reliability

SUMMER IN WISCONSIN. Responding to concerns about the electric shortages of the summer of 1997 and fears that they could happen again, Wisconsin PSC Commissioner Joseph P. Mettner has indicated that the state's energy supply outlook for the summer of 1998 appears much better in eastern Wisconsin than it did one year ago.

Mettner noted that Wisconsin's electric supply system is operating with expected reserve margins of 19.2 percent. But he cautioned that electric power flows do not respect borders.

TELEPHONE BILLING PRACTICES. Citing the filed-rate doctrine, which bars deviation from published tariffs, a federal appeals court affirmed the dismissal of two class action suits against AT&T Corp. that sought damages for alleged fraud. The suite arose from AT&T's failure to disclose to its residential long-distance telecommunications customers its practice of rounding charges up to the higher full minute.

Courts

ENERGY SUPPORT SERVICES. An Illinois appeals court affirmed a 1997 decision by the state commission that had denied authority to Commonwealth Edison to offer "energy support services," such as design, engineering, construction, analysis and management of electrical power equipment and energy systems. The court made this decision despite the utility's argument that no evidence existed to support the commission's finding that ComEd enjoyed a monopolist's advantage over competitors.

State Legislatures

CALIFORNIA ELECTRIC RESTRUCTURING. California Assemblywoman Diane Martinez, chairwoman of the Utilities and Commerce Committee, has introduced two new bills aimed at protecting consumers in a competitive market. But the measures already have been put on hold for this year. The first bill, AB 579, would cut rates for residential and small-volume commercial customers by 20 percent, rather than by 10 percent as promised in the state's restructuring act, AB 1890.

COMED appointed S. Gary Snodgrass as vice president of human resources for ComEd and its parent company, Unicom Corp.

The board of directors of Bay State Gas Co. elected Debra P. Cornish vice president of culture development. Previously, Cornish held positions as manager, compensation and employee relations, cost analyst and external reporting analyst.

MCN Investment Corp. promoted Joseph L. Roberts Jr. to president from vice president of MCNIC Pipeline & Processing Co. Roberts was also elected to the MCNIC board of directors. He remains vice president of MCNIC Power Co.

IF THE 1997 ULTRA COMPETITION CAN SERVE AS A GUIDE, then perhaps the forgotten "wires" business offers the next great opportunity for new applications in information technology.

That's the lesson of this year's contest, which saw Kansas City Power & Light Co., and Arizona Public Service Co. win the top two prizes. Each company gained recognition for IT applications designed in large part to modernize electric utility distribution systems.

An Illinois appeals court has questioned the idea that Commonwealth Edison Co. faces a higher degree of risk than other utilities (and thus deserves a higher return on equity), but also has affirmed the "used and useful" status of the company's Byron 2 and Braidwood 1 & 2 nuclear units, as approved by the Illinois Commerce Commission in a 1995 rate case order, which had helped justify a $303-million increase in annual rates.
