Germany: Taking the Lead in Electricity and Gas

Once trailing, but now the frontrunner, Germany attempts to remake its fragmented energy markets - with no new federal bureaucracy.

Here's a timely recommendation for U.S. electric power executives: Maybe it's time to brush up on those long-forgotten high school German lessons. Suddenly, the German electric power market has become the fastest changing in the world. It all happened in less than the two years passed since Germany enacted a new energy law, which became fully effective on April 28, 1998.

The Electric Power Supply Association elected B. Kent Burton, senior vice president of policy and international government relations for Ogden Energy Group, its chair for 2000. Kenneth E. Randolph, senior vice president and general counsel for Dynegy Inc., was named EPSA's first vice chair, and Bill Mack, president and chief executive officer of Coastal Power Co., was named second vice chair.

EPSA also named Donn Salvosa manager of government affairs and Shannon Gordon manager of finance and administration.

The traditional models no longer work very well. Dividend discount models will not work well if utilities cut dividends and buy back stock to return capital to the shareholders. Earnings growth offers no reliable performance gauge either, as utilities acquire or divest large amounts of capital. Restructuring charges often become necessary to shift resources to their best use.

Options and insurance each has a niche, but price collars are cheaper and more adaptable to market risk and customer behavior.

During the summers of 1998 and 1999, wholesale prices in the Midwest soared to $7,000 or more per megawatt, in comparison to a more typical summer price of $30 to $50 per megawatt. In a competitive environment, electricity suppliers - that is generators, utilities, marketers, etc. - will offer a variety of pricing products ranging from flat rates to real-time pricing (RTP). By varying degrees, price risk will be passed to the end-user.

The New York PSC told retail suppliers that to serve firm retail gas load they must have rights to firm, non-recallable, primary delivery point pipeline capacity for the five winter months, November through March, or else must augment secondary capacity with a standby charge payable to local distribution companies holding primary rights.

J. Kay Smith was appointed vice president of corporate communications and public policy at Ameren Corp. Smith was promoted from assistant to the president for AmerenCIPS and manager of government affairs for Ameren Services.

Duke Energy International appointed David Weaver executive vice president for Europe.

Natural Gas Retail Choice. Utility affiliates hold large market shares in natural gas customer choice programs, raising questions about the extent of true competition, according to a study released on Dec. 15 by the U.S. General Accounting Office. Participation varies by region, however, according to the report, "Energy Deregulation - Status of Natural Gas Customer Choice Programs."
