Joint Ventures. The Federal Trade Commission, in consultation with the Antitrust Division of the U.S. Department of Justice, issued draft antitrust guidelines for "collaborations among competitors" that will apply to a wide range of joint ventures and strategic alliances other than actual mergers.

Such collaborations would include R&D efforts, information sharing and joint efforts in marketing, distribution, sales or purchasing, plus various types of trade association activities. File No. 971201, Oct. 1, 1999 (F.T.C.), published at 64 Fed. Reg.

How to place a value on a utility company? That is the question.

The traditional models no longer work very well. Dividend discount models will not work well if utilities cut dividends and buy back stock to return capital to the shareholders. Earnings growth offers no reliable performance gauge either, as utilities acquire or divest large amounts of capital. Restructuring charges often become necessary to shift resources to their best use.

The Federal Energy Regulatory Commission appointed Bud Earley policy advisor on electric matters. Earley most recently served as director of the electric policy division of the FERC's Office of Economic Policy. The FERC named Bobbie J. McCartney an administrative law judge. She previously served as deputy chief administrative law judge in the Social Security Administration's Office of Hearings and Appeals.

The Bonneville Power Administration named Jeff Stier its new vice president of national relations. Stier joins BPA after 12 years on the staff of Rep.

Stephen W. Bergstrom was named president and chief operating officer of Dynegy Inc. Bergstrom formerly was president and COO of Dynegy Marketing and Trade and senior vice president of Dynegy Inc.

Texas-New Mexico Power Co. promoted Robert E. Castillo to vice president and regional customer officer for its Mountain Region. Castillo, formerly assistant vice president-New Mexico, replaces Allan Davis, who retired after 34 years with TNMP.

William W. Schivley was named president of Select Energy, Northeast Utilities System's marketing affiliate.

Year 2000 Readiness. On Jan. 11 the North American Electric Reliability Council (NERC) predicted a minimal effect on electric system operations from Y2K software problems. The Department of Energy, which had asked NERC to run the electric industry assessment, added that 98 percent of U.S.

Bob Rowe of the Montana Public Service Commission was elected first vice president of the National Association of Regulatory Utility Commissioners. Rowe will continue to serve as chairman of the NARUC Telecommunications Committee for another year.

Duane, Morris & Heckscher LLP added Regina Speed-Bost to its energy group. Speed-Bost is the former legal advisor for natural gas and oil pipeline matters to William L. Massey, commissioner, Federal Energy Regulatory Commission.

The Natural Gas Supply Association promoted John H. Sharp and Philip M. Budzik. Sharp, the association's chief lobbyist and counsel since 1988, became vice president, federal and state government affairs, and counsel. Budzik, previously director of research and analysis, was named vice president, federal regulatory affairs and technical analysis.

Bob Wentland joined Coherence Technology Company Inc. as research geophysicist. Wentland also is the manager of product development for CoherentVision(. Wentland's career includes 16 years with Shell Oil Co.

Distributed Generation. California opened a rulemaking proceeding to consider regulatory reforms in electricity distribution service, with a possible focus on distributed generation. The commission emphasized that its intent was not to define new policies, but to gather information. Comments are due March 17, and the commission intends to consider a proposal from the assigned commissioner this summer. Rulemaking 98-12-015, Dec. 17, 1998 (Calif. P.U.C.).
