The most common strategic issue depriving utility executives of sleep is the looming clash of investor expectations for steady growth in earnings compared with what utilities can deliver given slow growth in customers and demand. While many dream of assured regulated rates of return, the reality for most utilities is that the 1.5 percent retail growth experienced between 2002 and 2003 will prove unsatisfactory for earnings.

Irregular seams affect ratemaking policies.


In a case that marks the first time the Federal Energy Regulatory Commission eliminated inter-RTO rate pancaking, the commission in late July issued an order terminating regional through-and-out rates (RTORs) charged by two regional transmission owners (RTOs)-Midwest Independent System Operator (MISO) and PJM Interconnection. The decision removes an estimated $250 million in yearly fees collected by those two entities.

With an average appreciation of 18.9 percent since we last ran SNL Financial's dividend data , SNL's safe dividend picks appeared to do well for any market. However, like the fine golden years of the late '90s for all things technology, recent months have returned sizable gains to investors of energy stocks-not what one would expect from slow growth, dividend-paying electric and gas utilities that make up the majority of the SNL Energy universe.

President Bush named Dr. Nils J. Diaz chairman of the Nuclear Regulatory Commission (NRC), succeeding Richard A. Meserve. Diaz's current NRC term expires in 2006. Diaz also is professor-emeritus of Nuclear Engineering Sciences at the University of Florida.

Pantellos named Jim Neikirk president and CEO. Neikirk spent five years at Entergy Corp. as vice president and chief procurement officer.

The North American Electric Reliability Council (NERC) promoted Dave Nevius to senior vice president; David Cook to vice president and general counsel; and Don Benjamin to vice president. Nevius has been a vice president at NERC since 1986; Cook has been NERC's general counsel since 1999; and Benjamin has been director of operations since 1985.

Ameren Corp. named Martin J. Lyons vice president. Lyons has been the company's controller since joining Ameren in October 2001.
